NOTICE IS HEREBY GIVEN THAT, the Upper Bern Township Board of Supervisors will hold a hearing and then consider for adoption the following Ordinance at the Board of Supervisors Meeting scheduled for September 10, 2026 at 6:00 P.M. located in the Township Municipal Building at 25 North 5th Street, Shartlesville, Pennsylvania 19554:

Ordinance Number 173 of 2026. An Ordinance Amending the Upper Bern Township Zoning Ordinance of 2008, by Adding Article 8, Section 832 (“Data Center Uses”); and by Amending Article 2, Section 202 (“Definitions”).

Section 832. Data Center Uses includes the following subsections: Interpretation; Districts; Dimensional Requirements; Conditional Use Provisions (including Setbacks, Buffer Yards/Berms, Noise and Vibration, Water and Sewer, Cooling System Requirements, Power Supply, Emergency Planning and Management, Signal Interference, Economic Cost/Impact Assessment, Heat and Light, Parking, Aesthetics, Design and Construction, Environmental Impact Study, Electronic Watse and Decommissioning Plan(s)); and Signs.

An Ordinance Amending the Upper Bern Township Zoning Ordinance of 2008, by Repealing Article 9, Section 922, Subsection C (“Alternative and Renewable Energy Systems – Solar Energy Systems”); by Adding or Otherwise Adopting Article 9, Section 925 (“Solar Energy Systems”); and by Amending Article 2, Section 202 (“Definitions”).

Section 925. Solar Energy Systems includes the following subsections: Use Authorization and Districts; General Standards (including Codes and Standards, Prerequisite Qualifications, Undergrounding, Stormwater, Lot Coverage, Public Utility Notice and Approval, Reflectivity, Signage and Advertisement(s), Conservation of Wooded Areas, Limitation on Placement, Maintenance, Violations and Enforcement, Hazard Warnings and Safety, Additional Requirement for Zoning Permit Application, Expansion and Modification, No Right by Permit); Accessory Solar Energy System (ASES) Requirements; Principal Solar Energy System (PSES) Requirements; Other Requirements; Preemption.
